These Terms of Service ("Terms") govern your access to and use of the podmemo mobile application (the "Service"), operated by podmemo ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
You must meet the minimum age requirement for podmemo on the App Store in your country or region to use the Service. By creating an account, you represent and confirm that you meet this requirement. Some podcast content available through the Service may contain explicit language or mature themes.
You must create an account to use the Service. You agree to provide accurate and complete information, keep your login credentials secure, and notify us promptly of any unauthorized access to your account. You are responsible for all activity under your account.
podmemo is an iOS application that generates AI-powered summaries of publicly available podcast episodes. The Service processes podcast content from sources including YouTube and publicly available podcast feeds (such as RSS feeds and Apple Podcasts) through third-party AI models (including Google Gemini and OpenAI) to produce narrative summaries, key takeaways with timestamps, and related features. podmemo does not host or redistribute original audio or video content — it provides original AI-generated summaries and links to the original content sources.
The Service includes features such as a curated episode feed, AI-generated summaries and key moments, an option to ask questions about specific episodes, channel discovery and search, a podcast request feature for Premium subscribers, and episode bookmarking.
podmemo is an independent product and is not affiliated with, endorsed by, sponsored by, or partnered with YouTube, Google, Apple, OpenAI, or any podcast creator, podcast network, or content host. All third-party trademarks are the property of their respective owners and are used for identification purposes only.
Plans
The Service offers the following tiers:
Billing
Paid subscriptions are billed monthly through Apple's App Store. Your subscription automatically renews each month unless cancelled. By subscribing, you authorize recurring charges to your payment method on file.
Free Trial
New subscribers may be eligible for a 7-day free trial. Your free trial will automatically convert to a paid subscription unless you cancel at least 24 hours before the trial ends. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends.
Pricing Changes
We reserve the right to change pricing at any time. We will provide existing subscribers with notice before pricing changes take effect.
Plan and Feature Changes
We may add, modify, or remove features from any plan at any time as the product evolves. This includes changes to usage limits (such as the number of questions per month), the set of features included in Free or Premium, and the availability of specific features. We will provide existing subscribers with reasonable notice of material changes to Premium features before they take effect. If a change materially reduces the features available to you as a paying subscriber, you may cancel your subscription in accordance with Section 5 and the applicable App Store refund policies.
You may cancel your subscription at any time through your Apple ID account settings. Upon cancellation, you retain access to paid features until the end of your current billing period. After your billing period ends, your account reverts to the Free plan. Your saved episodes are preserved.
Refunds are handled by Apple in accordance with their refund policies. If you believe you were charged in error, contact Apple Support or reach us at support@askagora.ai.

Your Data
You retain ownership of any content you submit. By using the Service, you grant us a license to process your content solely for the purpose of providing the Service, including sending your inputs to third-party AI providers to generate responses.
AI-Generated Content
AI-generated content is produced by third-party AI models and are provided "as is." AI-generated content may contain errors, inaccuracies, or outdated information. You should independently verify any AI-generated content before relying on it. We do not guarantee the accuracy or completeness of any AI-generated summary.
Third-Party Podcast Content
podmemo processes publicly available podcast content from sources including YouTube, RSS feeds, and Apple Podcasts. All original audio and video content remains the property of its respective creators and hosts. podmemo does not host, store, or redistribute original audio or video content. Summaries are original AI-generated works derived from publicly available content.
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be unavailable due to maintenance, third-party API outages, or technical issues. AI model availability may change without notice. We reserve the right to modify, update, or discontinue features at any time.
The Service relies on third-party providers including Google (Gemini AI, YouTube Data API), OpenAI (GPT models), Apple (App Store, StoreKit, Apple Podcasts directory), publicly available RSS podcast feeds, and Firebase (infrastructure). We do not control these services and are not responsible for their availability or performance.
The Service, including its design, features, code, and branding, is owned by podmemo and protected by intellectual property laws. The "podmemo." name and logo are trademarks of podmemo.
Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, and protect your information.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
AI-GENERATED SUMMARIES ARE NOT A SUBSTITUTE FOR WATCHING THE ORIGINAL CONTENT. WE DO NOT WARRANT THAT SUMMARIES WILL BE ACCURATE, COMPLETE, OR FREE FROM BIAS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PODMEMO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless podmemo from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.
You may delete your account at any time through the Settings page. Account deletion is permanent and irreversible. All your data, including subscriptions, saved episodes, conversation history, and account information will be permanently deleted.
We reserve the right to terminate accounts that have been inactive for over one year and do not have an active paid subscription.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Before initiating formal proceedings, you agree to contact us at support@askagora.ai and attempt to resolve the dispute informally for at least thirty (30) days.
You may not use or otherwise export or re-export the Service except as authorized by applicable law, including but not limited to the laws of Canada and the United States, as well as the laws of the jurisdiction in which the Service was obtained. In particular, but without limitation, the Service may not be exported or re-exported (a) into any country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, or (b) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce Denied Persons List or Entity List. By using the Service, you represent and warrant that you are not located in any such country and are not on any such list. You also agree that you will not use the Service for any purposes prohibited by applicable law, including, without limitation, the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.
We may update these Terms at any time. We will notify you of material changes through the Service or via email. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.
